RESOLUTION NO. 3894 Passed November 3, 2025 RESOLUTION AUTHORIZING THE MUNICIPAL ADMINISTRATOR TO SELL SURPLUS CITY OWNED PROPERTY BY WAY OF INTERNET AUCTION WHEREAS, Ohio Revised Code Section 721.15(D) authorizes a municipal corporation to sell surplus city owned personal property by way of internet auction provided the legislative authority expresses its intent to sell surplus property on the internet and does so on a calendar basis; and WHEREAS, the Council of the City of Bowling Green wishes to provide the Administration additional tools to sell surplus property so that the best price may be obtained. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, OHIO THAT: SECTION 1. The Municipal Administrator is authorized to sell city surplus, obsolete, not needed or unfit for public use by way of internet auction for calendar year 2025. SECTION 2: The Municipal Administrator shall determine if the property is surplus, obsolete, not needed or unit for public use for purposes of Ohio Revised Code Section 721.15. SECTION 3: The Municipal Administrator may use professional internet auction services, such as, but not limited to govdeals.com and yoderandfrey.com, and is authorized to enter into such agreements as is necessary to conclude the sale of such surplus city property. Yoder & Frey is located at 2384 Grant Road, North Baltimore, OH 45872 and its telephone number is 419-865-3990. SECTION 4: The Municipal Administrator shall not offer for sale any surplus property on the internet for a period of less than ten calendar days. SECTION 5: The City shall advertise this internet auction policy as required by Ohio Revised Code Section 721.15(D). SECTION 6. The terms of the payment shall be by PayPal, wire transfer or credit card, with payment made directly to the professional internet auction service company, in full not later than five (5) days for the time and date of the close of the auction. Further, the successful bidder shall be solely responsible for pickup of items(s) purchased. SECTION 7: All property sold at auction shall be sold "as is, where is and with all faults." The City shall offer no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability on fitness for any purpose of the property offered for sale. The City shall reserve the right to reject any and all bids and to withdraw from sale of any of the items listed. Section 8: This resolution shall take effect at the earliest time permitted by law.
