NOTICE OF CANCELLATION OF OIL AND GAS LEASE To the following named Lessee and Lessee’s personal representatives, executors, administrators, heirs, devisees, legatees, successors and/or assignees at their respective last known addresses: The original Lessee was Claude E. Neeley of Midland, Texas with a full assignment to the Assignee Joseph I. O’Neill, Jr., whose last known address was 410 W. Ohio Ave., Midland, TX 79701, and whose personal representatives, executors, administrators, heirs, successors and/or assignees, devisees, and legatees are unknown and cannot with reasonable due diligence be determined; Pursuant to Sections 5301.332, you are notified that the Oil and Gas Lease (the “Lease”) dated August 6, 1964, recorded in Volume 59, Page 78, and further assigned in Volume 59, page 196, dated September 18, 1964 both of the Wood County, Ohio, Lease Records and all subsequent assignments thereof (including marginal assignments) is forfeited as to the following described real property, to wit: Being a parcel of land in the Southeast 1/4 of Section Thirty-two (32), Town Six (6) North, Range Ten (10) East, in Washington Township, Wood County, Ohio, and more particularly described as follows: Commencing at a point that is seven hundred twelve (712.00) feet westerly along the East-West Centerline of said Section Thirty-Two (32) from the East 1/4 Corner, said point being the point of beginning; thence southerly ninety (90) degrees a distance of two hundred ten (210.00) feet to a point; thence easterly ninety (90) degrees a distance of two hundred thirty-five (235.00) feet to a point; thence northerly ninety (90) degrees a distance of two hundred ten (210.00) feet to the East-West Centerline of said Section Thirty-Two (32); thence westerly along the East-West Centerline of said Section Thirty-Two (32) a distance of two hundred thirty-five (235.00) feet to the point of beginning. Containing approximately 1.13 acres of land, more or less. Tax par. #V72-610-320000022000 The Lease and any assignments therein are forfeited because the Lessee and Lessee’s personal representatives, executors, administrators, heirs, successors and/or assigns have failed to pay Lessor or Lessor’s successors in interest for oil and/or gas rentals or royalties as provided in the Lease and there are no producing or drilling oil and/or gas wells on the leased premises. Stewart Shepler and Kathryn S. Shepler, husband and wife, are the current owners of the real property which is subject to the Lease by virtue of instruments recorded at Deed Volume 609 Page 267, Wood County, Ohio and thereby are the successors to the original Lessor. Said current owners intend to file for record an affidavit of forfeiture with the Wood County, Ohio Recorder if you or your personal representatives, executors, administrators, heirs, successors and/or assign, do not have the Lease released of record within thirty days of the publication of this notice.
