RESOLUTION 3887 Passed August 4, 2025 RESOLUTION APPOINTING AN ASSESSMENT EQUALIZATION BOARD RELATIVE TO THE BOWLING GREEN CENTRAL BUSINESS SPECIAL IMPROVEMENT DISTRICT, INC.'S PLAN FOR SERVICES AS APPROVED BY RESOLUTION NO. 3884; AND FIXING THE TIME AND PLACE FOR SUCH BOARD TO HEAR OBJECTIONS TO ASSESSMENTS WHEREAS, the Council of the City of Bowling Green by Resolution No. 3834 adopted on June 2, 2025 (the "Resolution of Necessity") declared the necessity of implementing the Plan for Services of the Bowling Green Central Business Special Improvement District, Inc, (the "SID") and determined that a portion of the cost of the Project shall be paid by assessments in proportion to the front footage of the lots and lands benefiting under the Plan, said lots and lands being more specifically described in Exhibit A to said Resolution of Necessity; and WHEREAS, the Bowling Green Central Business Special Improvement District, Inc. has prepared assessments for the Project in conformity with the Resolution of Necessity and has filed such assessments with the Clerk of Council; and WHEREAS, the Clerk of Council has caused notice of the adoption of the Resolution of Necessity and the filing of the assessments to be served in the manner provided by law on the owners of all lots and lands to be assessed; and WHEREAS, objections to the amount or apportionment of, or the assessment against, certain lots or parcels of land to be assessed have been filed by the owners thereof with the Clerk of Council pursuant to Section 727.15 of the Ohio Revised Code; and WHEREAS, the City Council desired to appoint an Assessment Equalization Board pursuant to Section 727.16 of the Ohio Revised Code to hear such objections; BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BOWLING GREEN. OHIO THAT: SECTION 1: Jeffrey Crawford, Michael Rywalski, and Karen Seeliger, three disinterested freeholders of the City are hereby appointed to act as an Assessment Equalization Beard to hear and determine all timely written objections to the estimated assessments heretofore reported to this City Council for the Project, in accordance with law and with the Resolution of Necessity. SECTION 2: Such board shall first meet for the above purpose in the Council Chamber, City Administrative Services Building, 305 N. Main Street, Bowling Green, Ohio, on Tuesday, August 12, 2025, at 7.00 p.m. and upon completion of such equalization, shall report such equalized assessments to the City Council. SECTION 3: The Clerk of Council is hereby authorized and directed to notify the persons who have filed objections to such estimated assessments of the time and place of the hearing of such Assessment Equalization Board in accordance with Section 727.16 of the Ohio Revised Code. SECTION 4: It is hereby found and determined that all formal actions of this Council concerning and relating to the passage of this Resolution were adopted in an open meeting of this Council, and that all deliberations of the Council and of any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements, Including Section 121.22 of the Ohio Revised Code. SECTION 5: This resolution shall take effect at the earliest time permitted by law.
