Notice is hereby given that on March 26, 2025 in the above titled action Plaintiff Melissa Barwig filed a civil complaint against Defendant Brody Reese dba Brody Reese Roofing in the Common Pleas Court of Wood County, Ohio regarding a certain contract entered into by Plaintiff and Defendant on September 3, 2024 for the installation of a roof and related services at 1621 Muirfield Drive, Bowling Green, Ohio 43402. Plaintiff's Complaint alleges that despite Plaintiff's full performance under said contract, including payment in full of the contract price, Defendant intentionally, fraudulently, and negligently materially breached said contract by his failure to perform and complete all contracted work in a competent, satisfactory, and workmanlike manner, by his failure to correct substantial defects, by his failure to reasonably and properly select competent subcontractors and adequately supervise the subcontractors, by failing to adequately afford Plaintiff remedies provided by the Warranty, by failing to make the said warranty available for Plaintiff to read and review, and by failing to register said warranty. Plaintiff's Complaint further alleges that Defendant has been unjustly enriched and Defendant committed unfair, deceptive, and unconscionable acts and practices in violation of O.R.C. 1345.02 and 1345.03. As a direct and proximate result of Defendant's material breaches of the Contract and other actions, Plaintiff has suffered and will suffer monetary damages, including the amount necessary to pay another contractor to replace or correct Defendant's work and repair water intrusion damages. The purpose of said civil action is for Plaintiff to obtain a judgment against Defendant from the Wood County Common Pleas Court for monetary damages, including actual, treble, punitive, and statutory damages in an amount greater than twenty-five thousand dollars ($25,000.00), Plaintiffs costs and expenses of this action, including her reasonable attorney fees, and all other legal and equitable relief to which Plaintiff may be entitled as more fully set fully set forth in Plaintiff's Complaint. Plaintiff's Complaint may be viewed or obtained at the Office of the Wood County, Ohio Clerk of Courts, One Courthouse Square, Bowling Green, Ohio 43402.Defendant may file an answer in such action setting forth any defenses to Plaintiff's Complaint. Defendant's Answer shall be filed in the office of the Wood County Ohio Clerk of Courts and a copy of Defendant's Answer shall be served on plaintiff's legal counsel of record, Attorney Thomas H. Vogtsber at 521 North Main Street, Suite A, Bowling Green, Ohio 43402, on or before twenty (28) days after the date of final publication of this notice, July 23, 2025. If no answer to Plaintiff's Complaint is so filed and served by Defendant on or before the date specified as the last day for filing such Answer, judgment as prayed for by Plaintiff may be taken as default against Defendant. After the jounalization of such judgment, Defendant may be barred from asserting defenses to Plaintiff's complaint. Douglas F.
