Ordinance No. 9378 Passed September 8, 2026 Emergency Clause Adopted 9-8-26 ORDINANCE FOR SIDEWALK REPAIRS BY SPECIAL ASSESSMENT AND DECLARING AN EMERGENCY WHEREAS, the City of Bowing Green has mandated property owner sidewalk responsibilities that require landowners to maintain and repair public sidewalks on their property that abuts any public way; WHEREAS, when a property owner fails to comply with these responsibilities, the Council of the City of Bowling Green will take action to recoup repair costs; WHEREAS, when City sidewalk repair funds are available, then the repairs may be paid 50% by the city and 50% by the property owner. WHEREAS, the above noted failure to comply also applies to the City's 50/50 sidewalk program; BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, OHIO THAT: SECTION 1: Pursuant to ORC 727.01 Power to levy and collect special assessments, each municipal corporation shall have special power to levy and collect special assessments. SECTION 2: The Clerk of Council is hereby directed to submit a certified assessment and a certified copy of this ordinance to the Auditor of Wood County, Ohio. SECTION 3: This Ordinance shall take effect as an emergency measure. The reason for the emergency is that the prompt effectiveness of this measure is necessary in order to meet the submission deadline, and thereby protect the public health, safety and well-being of our citizens.
