Resolution No. 3915 Passed September 8, 2026 Emergency Clause Adopted 9--26 RESOLUTION DECLARING THE NECESSITY AND INTENTION OF APPROPRIATING PROPERTY OWNED BY BENTWOOD ESTATES LTD. FOR THE CRIM SHARED USE PATH PROJECT AND DECLARING AN EMERGENCY BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BOWLING GREEN, OHIO THAT: SECTION 1: The Bowling Green City Council declares its intention to appropriate real property from Bentwood Estates Ltd. as to portions of real estate on Crim Street ad Scott Hamilton Avenue in Bowling Green, as collectively more fully described on Exhibit A. SECTION 2: Negotiations for the acquisition of the described property interests have been unsuccessful to date and that the acquisition of the property interests described in Section 1 is necessary for the Crim Shared Use Path project. SECTION 3: It is ordered and directed that, once adopted, the Clerk of Council shall serve this Resolution as required by law, via certified mail, upon the representative(s) of the owner(s) of the described real estate, as shown on attachment. SECTION 4: This Resolution is necessary and for a public use. SECTION 5: This Resolution is declared to be an emergency measure and shall be in force and effect from and after its passage. The reason for the emergency lies in the fact that the same is necessary fir the immediate preservation of the public peace, health, safety and property, and for the further reason that the acquisition of the property interests described in Section 1 is necessary for the timely construction of the Crim Shared Use Path Project.
